  1. END-USER LICENSE AGREEMENT

  3. IMPORTANT-READ CAREFULLY: This End-User License Agreement ("EULA") is
  4. a legal agreement between you (either an individual or a single
  5. entity) and Bearded Toad Entertainment, LLC. ("Bearded Toad Entertainment")
  6. for the software Fish Tank Terror, which includes computer software 
  7. and may include associated media, printed materials, and "online" or
  8. electronic documentation ("SOFTWARE").  By exercising your rights to make
  9. and use copies of the SOFTWARE, you agree to be bound by the terms of
  10. this EULA.  If you do not agree to the terms of this EULA, you may not
  11. use the SOFTWARE.

  13. LICENSE

  15. 1.    GRANT OF LICENSE.
  16.  
  17. This EULA grants you the following rights:
  18.  
  19. a)    You may install and use only one copy of the SOFTWARE at any 
  20.     given time.
  21.  
  22. b)    You may not reproduce or distribute copies of the SOFTWARE.
  23.  
  24. c)    Decompilation, and Disassembly.  You may not reverse engineer,
  25.     decompile, or disassemble the SOFTWARE, except and only to the 
  26.     extent that such activity is expressly permitted by applicable 
  27.     law notwithstanding this limitation.

  29. d)    The SOFTWARE is licensed as a single product.  Its component 
  30.     parts may not be separated for use on more than one computer.
  31.  
  32. e)    You may transfer all of your rights under this EULA, provided 
  33.     the recipient agrees to the terms of this EULA.
  34.  
  35. f)    Without prejudice to any other rights, Bearded Toad Entertainment
  36.     may terminate this EULA if you fail to comply with the terms
  37.     and conditions herein.  In such event, you must destroy all
  38.     copies of the SOFTWARE and all of its component parts.

  41. 2.    COPYRIGHT.
  42.  
  43. The SOFTWARE is protected by copyright laws and international
  44. copyright treaties, as well as other intellectual property laws and
  45. treaties.  All title and copyrights in and to the SOFTWARE (including
  46. but not limited to any images, photographs, animations, video, audio,
  47. music and text incorporated into the SOFTWARE), the accompanying
  48. printed materials, and any copies of the SOFTWARE are owned by
  49. Bearded Toad Entertainment.

  52. 3.    LIMITED WARRANTY.
  53.  
  54. a)    NO WARRANTIES.
  55.     Bearded Toad Entertainment expressly disclaims any warranty for
  56.     the SOFTWARE.  The SOFTWARE is provided "as is" without warranty
  57.     of any kind, either express or implied, including, without
  58.     limitation, the implied warranties of merchantability, fitness
  59.     for a particular purpose, or noninfringement.  The entire risk
  60.     arising out of use or performance of the SOFTWARE remains with
  61.     you.

  63. b)    NO LIABILITY FOR CONSEQUENTIAL DAMAGES.
  64.     In no event shall Bearded Toad Entertainment, its employees, 
  65.     contractors, or its suppliers be liable for any damages whatsoever
  66.     (including, without limitation, damages for loss of business
  67.     profits, business interruption, loss of business information, or
  68.     any other pecuniary loss) arising out of the use of or inability
  69.     to use the SOFTWARE even if Bearded Toad Entertainment has been
  70.     advised of the possibility of such damages.

  72. c)    NO LIABILITY FOR ERRORS OR OMISSION.
  73.     Bearded Toad Entertainment expressly disclaims any liability for
  74.     errors or omissions in the content of the SOFTWARE.

  76. 4.    RESERVATIONS.
  77.  
  78. All rights to the SOFTWARE not expressly granted herein are reserved
  79. by Bearded Toad Entertainment.

  81. 5.    MISCELLANEOUS
  82.  
  83. This EULA shall be governed and construed in accordance with the laws
  84. of the state of Texas, USA and shall benefit Bearded Toad Entertainment, its 
  85. successors and assigns.
